EventSnap is a software product developed and supplied by Capture Commerce ("we", "us", "our"), a sole trader business trading in England and Wales. Our contact email is [email protected].
References to "you" or "the Subscriber" mean the individual or business purchasing a licence to use EventSnap.
On receipt of valid payment and issuance of a Licence Key, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on hardware you own or control, for your own internal business or personal purposes, for the duration of your active Subscription.
You must not:
Each Licence Key is issued to one named Subscriber and may be activated on hardware operated by that Subscriber. If you require additional licences (for example, for multiple operators within a business), please contact us.
The Software periodically validates your Licence Key against our remote licence server. A grace period applies for offline use. If your Subscription lapses or your key is invalidated, the Software will cease to function until a valid licence is restored.
In particular, during the Beta period:
We will give you reasonable notice of any material changes that affect your use of the Software.
Current Beta pricing is £30 per month or £300 per year (inclusive of any applicable taxes). Payments are processed by Stripe. By completing a purchase you also agree to Stripe's terms of service.
The monthly plan carries a minimum commitment of six months (£180). By subscribing monthly you agree to pay for a minimum of six consecutive monthly billing periods before cancellation takes effect.
A Licence Key is issued on your first payment and remains valid while monthly payments are current. Access to the Software is contingent on uninterrupted payment — your Licence Key will be deactivated if payment ceases and is not resumed within the grace period set out in Section 5.4.
Subscribers who maintain uninterrupted monthly payments are not subject to any reactivation fees, for however long they continue their subscription.
Annual subscribers are issued a 12-month Licence Key on payment, covering the full year.
If a monthly payment fails, Stripe will retry the payment automatically. If three consecutive payment attempts within a single billing cycle fail, your subscription will be considered in default and we will notify you by email.
You will have 30 days from the date of first failed payment to resolve the outstanding balance and restore your subscription. During this period your Licence Key remains active. If payment is not resolved within 30 days, your subscription will be assumed terminated and your Licence Key will be deactivated.
Reactivation after a break in payment: If your subscription has lapsed — whether through failed payments or voluntary cancellation — and you wish to reactivate, a payment of £180 (equivalent to six months) is required before access will be restored. This applies regardless of how long the break has been. A new minimum six-month commitment then applies from the date of reactivation.
Three failed payment cycles: If three payment attempts fail within any single billing cycle during an active subscription, the reactivation fee of £180 applies immediately — even if the 30-day grace period has not yet elapsed.
We will give at least 30 days' notice of any price changes. Early adopter pricing commitments made at the time of your original subscription will be honoured in line with Section 4.
Monthly subscribers may cancel at any time by contacting us at info@capturecommerce.co.uk. Cancellation takes effect at the end of the current billing period. The six-month minimum commitment applies — no refunds are issued for any payments made within the minimum term. After the minimum term, no further payments are due following cancellation.
Annual subscribers may cancel at any time. No refunds are issued for any unused portion of an annual licence, except at our discretion.
EventSnap is intended for use by professional photographers and businesses. If you are nonetheless purchasing as a consumer (an individual acting wholly outside a trade or business), your statutory rights under English law are not affected by these Terms. If the Software is materially faulty or not as described, please contact us at [email protected] and we will work to resolve the issue promptly.
You agree to use the Software only for lawful purposes and in accordance with these Terms. You must not use the Software:
We reserve the right to suspend or terminate your licence immediately if we reasonably believe you are in material breach of this section.
The Software, including all code, design, branding, trade marks (including EventSnap, 3Secure™, and Capture Commerce), and associated materials, are and remain the exclusive intellectual property of Capture Commerce. Nothing in these Terms transfers any ownership to you.
Your Licence Key and Subscription give you a right to use the Software as described in Section 3 only. All other rights are reserved.
The Software is designed to operate as a local server and does not depend on continuous internet connectivity during events. However, licence validation requires periodic internet access. We do not guarantee that remote validation services will be available at all times, and a grace period is built into the Software to protect against brief outages.
Beta subscribers receive support via WhatsApp and email. We aim to respond promptly but do not guarantee specific response times. Support is provided in English, during reasonable hours.
We are committed to providing a high standard of onboarding and ongoing support. Your first event on EventSnap is not a solo mission — we will work with you to ensure you are set up correctly before you go live.
To the maximum extent permitted by law, our total aggregate liability in connection with these Terms or the Software (whether in contract, tort including negligence, or otherwise) shall not exceed the total fees paid by you in the 12 months immediately preceding the event giving rise to the claim.
We shall not be liable for any indirect, consequential, special, or incidental loss, including lost profits, lost revenue, lost data, or loss of business opportunity, even if we have been advised of the possibility of such loss.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.
The Software is provided for use at events and venues where connectivity and hardware conditions vary. We are not liable for any loss arising from hardware failure, venue network issues, or circumstances outside our reasonable control.
You may terminate your Subscription at any time by contacting us. Termination takes effect at the end of your current billing period or licence term. No partial refunds are issued except as described in Section 6.
We may terminate or suspend your licence immediately and without notice if you breach these Terms materially, particularly Sections 3 (Licence Restrictions) or 7 (Acceptable Use). We may also terminate with 30 days' notice if we discontinue the Software or the Beta programme.
On termination, your Licence Key will be deactivated and you must cease all use of the Software. Sections 8 (Intellectual Property), 10 (Limitation of Liability), and 13 (General) survive termination.
EventSnap is designed for use by professional photographers and businesses. Nothing in these Terms affects any statutory rights you may have under English law that cannot be excluded or limited by contract.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Capture Commerce regarding your use of the Software and supersede all prior agreements or representations.
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Software after that date constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Failure to enforce any provision of these Terms does not constitute a waiver of our rights to enforce it in the future.
